Most people think “in custody” means handcuffs, arrest, or jail.
But in LEGAL, custody can begin before a formal arrest.
The key question is whether a reasonable person would feel free to end the questioning and leave. Courts examine the full circumstances—not merely the location or whether handcuffs were used.
Simply saying “I understand” does not automatically place you in custody.
But agreeing to remain and answer questions may keep the interaction going.
That is why one important question is: “Am I free to go?”
Do not assume you are free merely because you have not been arrested.
Words matter. Position matters.
Understanding the encounter matters.
Knowing when to use lawful vocabulary and when to use LEGAL vocabulary makes you one of the most powerful people on earth.
