OATHS AND AFFIRMATIONS

1. The oath or affirmation of office to be taken by a member of the board shall be in one of the following forms:

I solemnly swear (affirm) that I will be loyal to Her Majesty the Queen and to Canada, and that I will uphold the Constitution of Canada and that I will, to the best of my ability, discharge my duties as a member of the (insert name of municipality) Police Services Board faithfully, impartially and according to the Police Services Act, any other Act, and any regulation, rule or by-law.

So help me God. (Omit this line in an affirmation.)

or

I solemnly swear (affirm) that I will be loyal to Canada, and that I will uphold the Constitution of Canada and that I will, to the best of my ability, discharge my duties as a member of the (insert name of municipality) Police Services Board faithfully, impartially and according to the Police Services Act, any other Act, and any regulation, rule or by-law.

So help me God. (Omit this line in an affirmation.)

2. The oath or affirmation of office to be taken by a police officer, special constable or First Nations Constable shall be in one of the following forms:

I solemnly swear (affirm) that I will be loyal to Her Majesty the Queen and to Canada, and that I will uphold the Constitution of Canada and that I will, to the best of my ability, preserve the peace, prevent offences and discharge my other duties as (insert name of office) faithfully, impartially and according to law.

So help me God. (Omit this line in an affirmation.)

or

I solemnly swear (affirm) that I will be loyal to Canada, and that I will uphold the Constitution of Canada and that I will, to the best of my ability, preserve the peace, prevent offences and discharge my other duties as (insert name of office) faithfully, impartially and according to law.

So help me God. (Omit this line in an affirmation.)

3. The oath or affirmation of office to be taken by an auxiliary member of a police force shall be in one of the following forms:

I solemnly swear (affirm) that I will be loyal to Her Majesty the Queen and to Canada, and that I will uphold the Constitution of Canada and that, when authorized to perform police duties by the chief of police, I will discharge my duties as an auxiliary member of the (insert name of police force) faithfully, impartially and according to law.

So help me God. (Omit this line in an affirmation.)

or

I solemnly swear (affirm) that I will be loyal to Canada, and that I will uphold the Constitution of Canada and that, when authorized to perform police duties by the chief of police, I will discharge my duties as an auxiliary member of the (insert name of police force) faithfully, impartially and according to law.

So help me God. (Omit this line in an affirmation.)

4. The oath or affirmation of secrecy to be taken by a police officer, auxiliary member of a police force, special constable or First Nations Constable shall be in the following form:

I solemnly swear (affirm) that I will not disclose any information obtained by me in the course of my duties as (insert name of office), except as I may be authorized or required by law.

POLICE OATH/SOLEMN AFFIRMATION REGULATION

Form of oath or solemn affirmation

1  For the purposes of section 70 of the Police Act, the following are to be used as the forms of oath or solemn affirmation, as applicable:

(a)for an officer other than an enforcement officer:

I, …………...[name], do [swear/solemnly affirm] that:

• I will be faithful and bear true allegiance to Her Majesty Queen Elizabeth the Second, Queen of Canada, Her Heirs and Successors;

• I will, to the best of my power, cause the peace to be kept and prevent all offences against the persons and properties of Her Majesty’s subjects;

• I will faithfully, honestly and impartially perform my duties as…………………………….. ;

(b)for an enforcement officer or bylaw enforcement officer:

I, …………...[name], do [swear/solemnly affirm] that:

• I will be faithful and bear true allegiance to Her Majesty Queen Elizabeth the Second, Queen of Canada, Her Heirs and Successors;

• I will faithfully, honestly and impartially perform my duties as………………………….. ;

(c)for a member of a board or committee, the director or any person employed or retained by, or engaged and retained by, the director:

I, …………...[name], do [swear/solemnly affirm] that:

• I will faithfully, honestly and impartially perform my duties as………………………….;

• I will not, except in the proper performance of my duties, disclose to any person any information obtained in the course of those duties.

Filing of form

2  An oath or solemn affirmation under section 1 must be made before a commissioner for taking affidavits for British Columbia and filed as follows:

(a)if the appointee is a provincial constable or an auxiliary constable, the oath or solemn affirmation must be filed with the commissioner;

(b)if the appointee is a municipal constable or special municipal constable, the oath or solemn affirmation must be filed with the chief constable of the municipal police department operating in the municipality for which the constable is appointed;

(c)if the appointee is a bylaw enforcement officer, the oath or solemn affirmation must be filed with the chief constable or officer in charge of the detachment of police operating in the municipality for which the bylaw enforcement officer is appointed;

(d)in all other cases not specified in paragraphs (a) to (c), the oath or solemn affirmation must be filed with the minister.
